The following Paris Baguette Gift Card Terms and Conditions (“Agreement”) describes the terms and conditions that apply to PB Gift Cards (“Cards”) issued for use in the United States. This Agreement is between you, the Cardholder, and Paris Baguette Gift Card Services, Inc. (“PB”). BY PURCHASING OR USING THE CARD, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE WITH THIS AGREEMENT, DO NOT PURCHASE OR USE THE CARD.
THIS AGREEMENT INCLUDES THE RESOLUTION OF DISPUTES BY ARBITRATION. PLEASE REVIEW THE PROVISIONS REGARDING ARBITRATION BEFORE PURCHASING OR USING THE CARD.
PB reserves the right to change this Agreement from time to time in its sole discretion. Any changes to this Agreement will be provided to you by any reasonable means, including, without limitation, by posting the revised version of this Agreement at www.ParisBaguette.com. YOUR CONTINUED USE OF THE CARD AFTER THE POSTING OF CHANGES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. Please refer to the Paris Baguette Privacy Policy located on the Paris Baguette website for information on the way information is used, handled and stored.
Gift cards are not intended to be used by, or targeted to, anyone under the age of 13 years old. You must be at least 13 years old to use the gift cards. If you are at least 13 years old but not yet 18 years old (or the legal age of majority if different in your jurisdiction), then you must review these terms with your parent or guardian and they must understand and agree to these terms in order for you to use the gift card.
CARDS ARE NOT VALID UNTIL PURCHASED AND ACTIVATED.
Cards do not expire, and no fees will apply.
You must be a PB Rewards members to send, receive, transfer, or share gift cards. In the Paris Baguette mobile app, you can:
- Send gift cards to other members as gifts
- Load cards for yourself
- Transfer an existing gift card to someone else (full or partial balance)
- Mutually share a single gift card
The Card is redeemable for purchases (other than the purchase of other gift cards) at any PB location in the United States and online at ParisBaguette.com. Cards may not be redeemed for cash, except to the extent required by law.
You may reload Cards at any PB location in the United States in an amount not less than $5.00. The maximum amount of available funds on the Card shall not exceed $100 at any time.
For security and fraud-prevention purposes, PB may limit the number and dollar amount of Cards that may be purchased or loaded within any 24-hour period. At this time, Card purchases are limited to no more than two (2) purchase transactions totaling no more than $100 in the aggregate within any rolling twenty-four (24) hour period. PB may modify these limits at any time in its sole discretion.
You may check the available balance on your Card by asking one of our staff members at any PB location in the United States or visiting www.ParisBaguette.com.
You may have the option to add funds to gift cards on the Paris Baguette mobile app on a recurring basis, using the payment method, reload amount and minimum balance recharge threshold of your choosing. Once enabled, this feature continues until cancelled without additional notice to, or authorization from, you. You may cancel auto-reloads in the mobile app any time prior to triggering your next minimum balance threshold amount. You can change your reload preferences at any time, but changes may take up to twenty-four (24) hours to go into effect.
When you select the auto-reload option, you grant permission to PB and/or its affiliates and third-party service providers to automatically charge the payment method chosen. Third party service providers may provide services under their own terms and conditions.
If we cannot charge your payment method for any reason, your auto-reload may not process.
We reserve the right, in our sole discretion, to pause or disable the auto-reload feature at any time. This may result from actual or suspected fraud, misconduct, illegal behavior, inactivity, maintenance, a change in law, a need for verifying information, a problem with the payment method on file (such as expiration or insufficient funds), cancelation of the auto-reload offering, your gift card balance exceeds $100 or a limit set by law or regulation, or for other reasons.
ALL CARD SALES ARE FINAL. NO RESALES, REFUNDS OR EXCHANGES OF CARDS OR CARD BALANCES (UNLESS REQUIRED BY LAW) ARE PERMITTED.
The value of any lost, damaged, altered, or stolen Card will not be replaced. You are responsible for all purchases made using your Card and do not have the right to stop payment on any such purchases.
TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, PB AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE CARDS, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, IN THE EVENT A CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF THAT CARD.
ARBITRATION – You and PB agree that any dispute, whether at law or in equity, arising out of, or related to this Agreement or your use of the Card, regardless of the date of accrual of such dispute, will be resolved in its entirety by individual binding arbitration, except that you or PB may take claims to small claims court if they qualify for said court. You and PB agree that any arbitration under this Agreement will take place on an individual basis and that class, mass, consolidated, or combined actions or arbitrations or proceedings as a private attorney general are not permitted. YOU AND PB WAIVE THE RIGHT TO TRIAL BY JURY. This agreement to arbitrate extends to claims asserted against other parties, including, without limitation, PB’s affiliates and related entities. The Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate. This agreement to arbitrate will survive the termination of this Agreement. Notwithstanding anything to the contrary, if any part of this agreement to arbitrate is deemed invalid or inapplicable, the remainder of this agreement to arbitrate will still be considered valid and enforceable. If any of part of this agreement to arbitrate is deemed invalid or inapplicable, you and PB both waive, to the fullest extent allowed by applicable law, any claims to recover punitive or exemplary damages and any right to pursue any claims on a class, mass, consolidated, or combined basis. The parties will submit to final and binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with AAA’s commercial arbitration rules. The arbitration will take place in California. Judgment on any arbitration award may be entered in any court having proper jurisdiction. The prevailing party in any arbitration will be entitled to reasonable costs and attorneys’ fees.
This Agreement will be governed by the laws of California without reference to its conflict of laws rules. You expressly consent and agree to submit to the exclusive jurisdiction and venue of the federal and state courts located in California.
The provisions of this Agreement are intended to be interpreted in a manner that makes them valid, legal, and enforceable. In the event any provision is found to be partially or wholly invalid, illegal, or unenforceable, such provision will be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. It is expressly understood and agreed between the parties that such modification or restriction may be accomplished unilaterally by PB or, alternatively, by disposition of an arbitrator or court of law. If such provisions cannot under any circumstances be so modified or restricted, they will be excised from this Agreement without affecting the validity, legality, or enforceability of any of the remaining provisions.
PB reserves the right to refuse to honor the Card where PB believes that use of the Card is unauthorized, fraudulent, or otherwise unlawful.
